The Position
The Fresno Superior Court has an opportunity for the Court Examiner I classification in Probate. This position will ensure the accuracy and completeness of case files; compliance with all legal statues, court rules, and policies; and reviews with the judge to ensure compliance with procedural requirements. In addition, will be responsible for reviewing the less complex case files before and after court sessions for accuracy and completeness of forms; determining what actions need to be taken; reviewing case files to assure timely follow-up of legal requirements; and maintaining case files.
Incumbents must have effective organizational, time management, and record keeping skills; good oral and written communication skills; ability to interpret and apply complex laws and regulations; knowledge of, and proficiency in legal research and maintain effective interpersonal relationships with judges, court staff, at all organizational levels, and with the public. In addition, must possess a high degree of maturity, integrity, and good judgment.
An eligibility list will be created from this recruitment and may remain in effect for up to twelve (12) months; however, the Court reserves the right to vacate the list and re-recruit at any time. The Court also reserves the right to utilize this list for other future vacancies in this classification.
The Minimum Qualifications
A Court Examiner I must qualify under one (1) of the three (3) options listed below.
Option 1
Education
Graduation with a Juris Doctorate from an educational institution approved by the American Bar Association or accredited by the Committee of Bar Examiners of the State Bar of California. AND
Experience
A minimum of six (6) months’ employment experience with one or more of the following employers: (a) a court; (b) a public or private law office; or (c) a public administrator, public guardian, public conservator, or private professional fiduciary.
Option 2
Education
Graduation with a Bachelor of Arts or a Bachelor of Science degree from a college or university that is acceptable within the United States’ accredited college or university system. AND
Experience
A minimum oftwo (2) years’ employment experience with one or more of the following employers: (a) a court; (b) a public or private law office; or (c) a public administrator, public guardian, public conservator, or private professional fiduciary.
Option 3
Education
A Paralegal Associate of Science Degree, Paralegal Associate of Arts Degree or completion of a Paralegal Certificate of Achievement Program which included at least three hundred (300) hours of classroom work from a college or university that is acceptable within the United States’ accredited college or university system. AND
Experience
A minimum of four (4) year’s employment experience with one or more of the following employers: (a) a court; (b) a public or private law office; or (c) a public administrator, public guardian, public conservator, or private professional fiduciary.
License: Possession of a valid California Class “C” Driver’s License may be required.
Sample of Duties
- Examines, reviews, and analyzes for compliance with procedural requirements with statutes, codes, court rules and policies, less complex motions, petitions, and other documents contained in probate, guardianship, mental health and conservatorship case files which are set for hearing in Superior Court.
- Evaluates, abstracts, summarizes, and notes discrepancies regarding the completeness and validity of probate petitions and documents for the attention of the Court.
- Consults with and reviews reports from court investigators, attorneys, the Public Guardian, and appropriate agencies.
- Confers with the probate judge and reviews petitions, which are complete and in order, or returns petitions, which are not complete, or not in order.
- Answers questions from attorneys and the public regarding procedural requirements of probate matters in cases pending or set for hearing.
- May perform other duties as assigned.
